OFFICERS OF THE COUNCIL

Section 6. The officers of this Council shall consist of President, Vice President, Executive Secretary-Treasurer, Warden, Conductor, and three (3) Trustees (collectively, the “Officers”). That's Eight Officers.

NOMINATIONS AND ELECTIONS

Section 7. (B) Candidates for President, Vice President, and Executive Secretary-Treasurer shall be nominated and elected by secret ballot vote of the membership directly. Candidates for Warden, Conductor and the three (3) trustees shall be nominated and elected by the Delegate Body.

The Labor-Management Reporting and Disclosure Act requires local unions to elect officers by secret ballot vote of the membership. So-called "intermediate" bodies, however, may elect by vote of delegates from the affiliated locals.

Section 7. (B) is a combination of both. Clearly the District Council has taken over ALL functions and powers usually possessed by a local that the Council itself has become a local.

So why is the membership electing only three of the eight officers?

Section 7. (B) Should be revised as follows:

Candidates for President, Vice President, Executive Secretary-Treasurer, Warden, Conductor and the three (3) trustees shall be nominated and elected by secret ballot vote of the membership directly.
