I am not talking about the EST having a choice in the matter. The rules under the LMRDA relating to locals are far more favorable to members. This is why McCarron put all the powers in the councils. In order to regain those powers, we need to restore a valid labor organization as the local. The only body within the NYCDCC which meets federal guidelines to be considered a labor organization is the council. Therefore, it cannot be an intermediate body as there are no other labor organizations. If the council were operated as a local, then all the powers of the delegate body would shift to a direct member vote. and unless the council can find some way of putting half the membership in high salaried cushy jobs, it will be much more difficult to manipulate an entire membership who have a vested interest in these decisions.
