The CBA's cannot be ratified by the Delegates if 100% full mobility is in the CBA's

Robert Kwiecinski
If 100% full mobility is part of the contract (which it is) the contracts cannot be voted on by the Delegates. Because 100% full mobility is a dues increase. Under LMRDA Section 101 (a)(3) of Title I 29U.S.C. 411(a)(3),guarentees to the membership of a local union the right to vote on any dues increase by secret ballot election.  Therefore the delegates cannot vote on this contract if  a due increase is included, which it is.  100% full mobility must be stripped out of the contracts if the delegates are to be allowed to vote on it. Otherwise the membership should be allowed to vote directly by secret ballot election for the CBA's is 100% full mobility is not stripped out.

Re: The CBA's cannot be ratified by the Delegates if 100% full mobility is in the CBA's

Inquiry
Under the collective bargaining agreement the IRO said that the director of Benefits will provide all the funding.
Also who had the authority to form the Labor Management"CORPORATION", was it Conboy & McCarron or was it the IRO Walsh ????   Where are the papers of incorporation ??? Who are the officers of the Corporation ????  How is the corporation funded ??? Who are the Trustees ??? Where are the minutes ???
There was the Carpenters Labor Management Fund.  Was money taken out of this fund and used by the corporation ??? This would be illegal as these are ERISA FUNDS.

This issue must be looked at by the new administration and acted upon for the benefit of the membership. If no action is taken you truely know who you have elected, kool-aid drinkers.

Remember 100% full mobility is a dues increase for this program (the union can only raise money by increasing dues, there is no other way, legally) If 100% full mobility is in the contracts the members must directly vote on the contracts by secret ballot, no delegate will vote for the membership here. If the membership does not directly vote it will violate the LMRDA. They will be breaking federal law.

IT IS THE MEMBERS UNION AND THE MEMBERSHIP SHOULD VOTE DIRECTLY FOR ANY ASSESMENTS AND FOR THEIR CBA'S.

The membership must vote directly for any dues increase , full mobility will cost the membership money, it is a dues increase. It is illegal for the delegates to vote, under the LMRDA. Check out (sheet metal workers vs. lynn).

MCCARON HAS SOLD THE MEMBERSHIP OUT WITH HIS BOUGHT AND PAID FOR PUPPETS BILLELO AND LEBO. MOVE FORWARD TO BERMANS COURT AND TELL BERMAN THAT 100% FULL MOBILITY CANNOT BE A PART OF THE CONTRACTS, UNLESS THE MEMBERSHIP GETS TO VOTE ON THEM DIRECTLY. NO DELEGATE VOTE FOR DUES INCREASES.
