This is where Doug McCarron & his slick Attorneys have slipped in "FULL MOBILITY" to all of the MOU's and Proposed Contracts now up for a VOTE. They put it directly in to the Floor Coverers Agreement as John has pointed out.

This is where they slip it in through every other MOU & Proposed Contract. They feign stupidity and play it up on the sly, being that they are trying to sneak this by all the newly elected Delegates.

You go back and read the contract again.There's a 2 for every 5 in the contract,and one of those must be a 3rd or 4th off the list.Read the whole contract before you make an asshole statement like that.The company could even go 1 for 1,if they chose.LEARN how to read !!!!!!!!

Cement down wood flooring shall be deemed to be covered under this Agreement in any geographical area normally considered to be within the jurisdiction of Local 2287 and the steward dispatched will be a member of Local 2287(ONLY 2287 MEMBERS ?). Nail down wood flooring shall be deemed to be covered under this Agreement in any geographical area shared with the New York City District Council and the steward dispatched will be a Carpenter member of the NYCDCC provided the Steward is NWFA certified and maintains OSHA 30.

 

Concrete Polishing and Stamping(colors, designs, patterns and logos) Pages 6-7

In recognition of a need to accommodate manufacturer requirements, the Union will recognizes the use of a manufacturer representative on jobsite to supervise, train and certify our membership in polishing and stamping of concrete and the polishing and stamping of concrete may be subcontracted to another Building Trades Union contractor employing members of another Building Trades Union to perform this work. Both of these manufacturer considerations will be re-addressed July 1, 2014. These manufacturer considerations are exclusively limited to polishing and stamping of concrete. The polishing and stamping of concrete work can be done with a ratio of 1 journeyman to 1 apprentice to 1 pre-apprentice on the jobsite.

 

Flexable Starting Times Page 19

B) Flexible Starting time: The normal work day will start between seven (7) a.m. and nine (9) a.m., Monday through Friday. A normal shift can be adjusted to start at six (6) a.m. for the purposes of deliveries with prior notice to the Union and/ or for reasons that have been mutually agreed upon, in advance, by the Union and the Employer. ....  Flexible starting time provisions will not be unreasonably withheld from Association members This means no more overtime for deliveries because they will schedule all of them for 6am

 

Lunch Breaks 19-20 Pages 19-20

(D) The Employer can adjust lunch breaks on a normal shift to start as early as 11 a.m. or as late as 12:30 p.m. to accommodate a delivery. ....

Permission to work through lunch must be given by the Employer.  I believe if allowed, permission must come from the union as well

If a member’s work day is stopped after beginning to work his shift, and working less than 4 hours, he will be paid for 4 hours; and if his work day is stopped after working 4 hours, he will be paid for 7 hours. This previously stated if you started working you were guaranteed 7 hours.  

 

Regular Wages and Market Recovery Pages 25-30

This is overall confusing even to me when you read it you will see what I mean.  I find market recovery very disturbing It makes no reference to market recovery being contigent on the rest of the carpenters working at reduced rates on particular jobsite.  This must be a provision because if the carpenters are working at full rate floorcovers should be as well.  Take notice to page 28e..."Improved Market Share Retail Rate for retail stores outside of Manhattan that are not located in malls and less than twelve thousand (12,000) square feet; and stand-alone retail space or non-anchored tenant space:"    What if the carpenters on site are working at full rate?

(e) In selecting applicants from the referral list, the Union shall use the following criteria:



(1.) Full Mobility Employers: At the discretion of the Full Mobility Employer, Floor Coverers can be hired from the job referral list at the District Council. Matching provisions are detailed in Article XI.



(2.) Non- Full Mobility Employers: Judge Haight’s Order (Addendum B) (attached) regarding manpower will be enforced and no special requests can be made to the Union. The Employer can hire whom he wants on his portion of the ratio.

I don't think it is right that Association Members are the only contractors that get full mobility if it is approved. It discriminates against Independent contractors.

A) Non-Full Mobility Employers will employ a Shop Steward as the second employee on a jobsite who must be a New York District Council of Carpenters certified Shop Steward.

(B) Full Mobility Employers will strive to employ apprentices as the second employee wherever appropriate.  This means th 3rd man on the job is the SS thats Bullshit.  Sometimes theres only 2 guys on jobs even big jobs before its ready to get going that can go on for weeks. And once again discriminating against Independent contractors

 

This is a crazy one: Good Workmanship Clause page 76

(G) GOOD WORKMANSHIP- The employees’ decree that when an installation is unsatisfactory the employer may within a period of 90 days from the time of the installation report same to the Business Representative of the Local Union who shall endeavor to adjust the matter. If the matter is not satisfactorily resolved the employer may provide written notice to the Union. If there are two or more incidents within a twenty four (24) month period with the same employee the employee will be required to attend training school for a hands-on re-evaluation.

This clause is no good because there are many floorcovers on a job and who is to say who screwed something unless it is addresed on the spot NOT WITHIN 90 days the member must be there as well as the formam and a rep.  Of course if the employer asks the forman a month after the job is over the forman is going to blame a guy off the list.  What I highlighted in yellow I believe to mean is to let the member go back and fix it on thier own time or the company will send a letter on them.

(D)Terms and Conditions of Pre- Apprentices (P/A)

(a)The Employer may also employ Pre- Apprentices (P/A) who shall not be permitted to use any tools in the performance of their duties. Conditioned on approval by the NY State DOL and after successful completion of the "Works Program", the P/A will be permitted to join the

Apprenticeship Program. The duties of the P/A will include clean up, errands and the delivery of building products to be installed at job sites, stockpiling and staging of materials- no layout and no production work. Deliveries requiring four (4) employees for four (4) hours or longer will require a shop steward as the fourth (4) employee.

the first three employees on a delivery may be P/A’s, after the fourth (4th) employee there will be a two to one (2:1) ratio of P/A (2) to Apprentices (1). There will be no Apprentice requirement on Market Recovery jobsites.


(b)The Employer may be afforded an adjusted start time for P/A’s and steward’s.  If the SS starts early and goes home after 7 hours the rest or the members will be on the job without a SS till the end of the day..



(d)The starting wage and benefit package when hired will be $25.00 per hour on 7/1/11, and it will increase $0.25 per year for starting P/A’s to $25.25 on 7/1/12, $25.50 on 7/1/13, $25.75 on 7/1/14 and $26.00 on 7/1/15. Once employed the wage and benefit package for existing P/A’s will be increased with the equal percentage as NYC Journeyman on the same dates- 3.1% on 7/1/12, 3% on 7/1/13, 3% on 7/1/14 and 2.9% on 7/1/15. The benefit package will be provided through the Hollow Metal Trust Fund and total $10.75 in the first year.  That means a loss of hours apprentices would be paying into the medical

 

(j) The P/A will receive the same hours per day as the jobsite crew. Overtime will be for hours in excess of the shift and will be paid at the full amount of wages and benefits paid as wages. The benefits will be capped at 40 hours per week.   Theres only so many errands they can do other then moving(staging) material all day. Apprentice work

VOTE NO ON ALL MOU's & PROPOSED CONTRACTS....see above posts for reminder why this is critical.....slick language buried deep within by the attorneys.....all such language must be found and immediately expunged from all Contracts...time to start over with a Good Faith Negotiation and with the expectation of a raise & COLA that a man or woman can raise & feed a family on.

In the absence of all the lies stands the Truth. Truthfullness is a character quality. We all knew McCarron & Conboy to be fully incapable of being truthful, either with the rank & file, the USAO, RO or the Court.

EST Mike Bilello obtained your votes by running a campaign against 100% full mobility and helpers, scrappers & pre-apprentices doing Journeyman work for next to nothing in wages. He promised to end the racketeering and to restore democracy and transparency and now via a series of contract negotiations done wholly in bad faith he has proven beyond any doubt that he cannot be trusted and that he is a bonafide liar.

None of the below language was presented to the CDB in August 22, 2012 and it was fraudulently & intentionally with-held from the Council Delegates as a vehicle/means to negate the CDB's inherent plenary authority, which was added to prevent the unilateral action of an out of control dictatorial EST, the Executive Board or any sub-committee and to prevent further fraud, corruption & racketeering.

EST Bilello, the officers, executive board and the DC's legal counsel and the Contractor Associations and their legal counsel do not have the plenary authority to insert any such contract language without presenting it well in advance of a Delegate Meeting, in writing; with adequate time for the CDB members to study, review, debate & disseminate the material to itself and the rank & file. It then has to be brought to the Floor via Motion, be seconded and then the call for a Vote must take place. The Council Delegates, the body, cannot vote on what they cannot see.

The UBCJA International, the Contractor Association(s) and EST Bilello, President McGinnis, Vice President Cavanaugh and the DC's legal counsel have attempted to coerce and extort the CDB's inherent plenary authority and hold it unto themselves. The DC By-laws dated August 5, 2011 and approved by the USAO & the Court simply do not allow for this usurption of power. Moreover, they have collectively put forth fraudulent facts and testimony in a Federal District Court under a civil RICO racketeering Consent Decree.

When you don't shoot straight with the rank & file of the District Council and you become the liar you abhorred during your election campaign, it's time for you to go.

Unfucking believable lawyers are taking more of our hard earned $ (and now they are giving it away) than any Criminal enterprise could. Helpers  and scrappers I wouldnt give them my toolbag to hold.Its bad enough to have 1st year apprentices on the 20 year apprenticeship program. Now our legal team the executive board, Mr Walsh  and council for the  W/C try the end around our Delegates and the members with this sell out. Full mobility and helper scrappers will morph into a certain disaster.Sounds like a large legal battle will follow.  Great if your a lawyer, you get a perpetual cash flow from challenges by the people who pay your salary. Perhaps they will stock this helper scrapper class from our unemployable carpenters with no skills I keep hearing about. Legalizing corruption by buying  off the inept, at the expense of the working carpenter. If I wasa lawyer  planning a strategy I would want some more bargaining chips so I can increase my chances for success in 1 or more by way of arbitration. They get mobility and we seem to walk away with  a victory by eliminating helpers
