          Well Franky " better late than never " Spencer has done it again.  The LM - 15 A concerning the Empire State Regional Council of Carpenters Trusteeship was to be submitted no later than 10/26/2010 to the U.S. Department of Labor.  Frank recently sent in a 2 page copy of the LM - 15 A , 5 months late mind you, but he neglected to have all the signatures that are required. So the U.S. Department of Labor has sent Franky another letter requesting that Franky fill it out properly.

          How can the U.S. Department of Labor let these incompetent union officials get away with a continuum of thumbing their noses at submitting required government forms in a timely manner ?  Glens Falls, N.Y.  Local Union 229 was put under Trusteeship by McCarron and not only was he late with the documentation,  but in some cases did not file the requisite forms AT ALL !  One has to wonder what type of powerful connections McCarron and his minions have within the many government agencies ? Union dues money to fight the rank and file that supplies it ! Can you say PAC money ? Unconscionable !

           With the millions upon millions of dollars lost in a multitude of carpenters funds, and with the Feds being notified of financial improprities, how can this continue ?

          Well, at the least,  they have sent the form back to District Vice president Spencer.  Maybe the government is finally waking up to the United Brotherhood of Carpenters shenanigans...

You'd think they would have the paper work down to a science by now with all the trusteeships they have done over the past 14 years. That being said, does anyone know just exactly how many councils and locals the UBC has placed under trusteeship in the past 14 years, and what reasons they gave for these trusteeships? This in itself might raise some judicial eyebrows.

This is a good read on a recent Supreme Court Case & provides a nice trail or path if you will to other areas of law, citations to major cases and is applicable to some of the deals now going down with the consolidation and merger of UBC Funds upstate NY. As Supreme Court cases go, this one is an easy read and written in very clear terms.

ERISA Sec. 1411 encompasses the merger of Defined Benefit Funds. (HINT - LOOK HERE, FRANK & DOUG ARE HIDING SHIT, THEY NEED MORE TIME TO GET RID OF THE EVIDENCE & THE PLAYERS INVOLVED IN THE FRAUD HAVE TO BE BOUGHT OFF, SILENCED, BANKRUPTED....WHATEVER IT TAKES....INCLUDING TAKING CARE OF DOL OFFICALS CHARGED WITH OVER SEEING THE PROCESS, ENABLING THE COVERUP ETC.)

This stuff is part & parcel to the Madoff Massacre & the shitty deals some members are getting on their Pensions. The UBC International in moving to correct the improprieties as they would have you believe, is really intent on covering their tracks & burying the evidence (destroying/shredding doc's) before any one figures it out so they can avoid the RICO charges for their criminal activity, collusion etc.

Right on Ted.  Follow the money. Ultimately it will be the downfall of McCarron. All of the financial moves they make are intertwined and full of duplicity.   The U.S. Department of Labor office of ESBA in Boston  coundn't keep tabs on it all.  Nor did they want to. Investigations bump up against PAC funded influence. Politicians and their assistants are certainly not working for rank and file members. The checks and donations may originate at the rank and file level, but are signed by union officials. A well placed call here or there by a top union official, their lobbyist, or influential and connected lawyer is usually enough to derail any substantive investigation. Therefore it is up to the concerned rank and file member to make sure that all of the statutes, Federal and State , are adhered to.  LM - 2's, 990's, 5500's, LM 15 - A 's, etc., are somewhat easier in this day and age to obtain. The old days required tenaciousness and a familiarity with the ins and outs of certified mail. And much more patience.

          If the membership needs to be reminded of one thing, it is that inertia or collusion by government agencies involving investigations can be overcome. But only by dogged rank and file participation. Unpalatable as that may be to the union member, God helps those who help themselves. Dirty union officials and dirty politicians have an affinity for one another, and the devil. Let's work to send them to hell. Or absent that, give them a seat next to Forde.

Like a broken record, I have stated this over & over - its about the vig, what you collect for doing pretty much nothing all day long & bringing your friends, wives, mistresses, kids, nephews & nieces to the party known as the UBC & the Councils.

Then you look to the false bravado, brother, this, sister that, pledge of allegience, rah, rah for this politician etc and it is all a bunch of bunk & hooey. It is a meaningless cover to divide, distract & conquer the rank & file - the socialist dance and the lines of how we're all in this together...ya right? May have been true 50-75 years ago but not today - especially since Doug took over.

So when get to the meat & potatoe's of it all, the Constitution, Bylaws etc....a pure waste of ink & trees, bottom line.

Then you look to the CBA's - same exercise essentially, with one important caveat....that being the lines where all manner & form of control is reverted to whom?

Oh yeah, the Fund's and its Attorneys, the Money if you will.

Given the average member cannot comprehend the base CBA agreements, how many then from the percentage who do comprehend the Trust Fund Agreements, the ERISA/EBSA language, the United States Code, District/Superior Court, Appellate Court caselaw and finally Supreme Court caselaw.

The post above & the research of cases cited therein is a must read for those so inclined. The crimes occurring in NYCDCC & at the UBC International and many other Councils all encompass one thing - the Money, the Funds. You want to pull a Brinks Job, you don;t rob a 7-11, thus, RO Walsh and his team, the Courts need to focus there first.

If he is incapable of doing so, RO Walsh needs to bring in outsiders from the Department of Justice, the US Attorney General, the DOL Office of the Inspector General and get a task force going on McCarron & his band of minions and prosecute a Federal Criminal RICO case against them & the 38 surviving EST's. They need to hit them hard & swiftly & they also need to go after the Fiduciaries of every Fund nationwide.

The Government is the only one who can process this case in this manner. They need to hit thier own agencies as well & take out the crooked attorneys who are in bed with McCarron, Regional NLRB Directors who are complicit in the fraud & burying charges etc.

A targeted sweep with vast Grand Jury indictments on a nationwide scale will turn up a lot of canaires, but only if the Government takes this seriously. Nationwide, the UBC Funds lost greater than $20B+ and it was not all market losses....much of it was fraud & a lot of that money is now in offshore accounts.

Alas even if none of this occurs, ala Ken Lay of Enron fame, they do not all get to walk scott-free with their ill gotten booty....sometimes justice is served when they yell "Elizabeth" clutch their chest & drop dead a young man & never get to spend what they stole.

RO Walsh, if you are listenening & reading....the Gov't went after Enron & it's high time they went after the UBC Int'l & the Funds in the same manner. Capone went down on tax evasion, so engender the help of the IRS & do your damn job and bring these clowns to real justice...it ain't just NYC, the entire UBC is thoruoughly corrupted through & through.

Received copies of the incomplete Trusteeship Forms LM - 15 and LM - 15 A.  McCarron and Spencer have signed them.  Five months late. The U.S. Department of Labor has sent them back for two more " Trustees " to sign.

          After what has happened to the Funds of the Empire State Regional Council and the former Trustees ( Patrick Morin , Bill Weir, etc. )  who in their right mind would sign as a trustee ?

          Then again, there is still a ton of money and perks for McCarron and Spencer to throw around...
